In order to ensure compliance with international commitments after joining new generation trade agreements including CPTPP, EVFTA and RCEP, on 16 June 2022, the Vietnam National Assembly has approved the 3rd Amendment of the 2005 IP Law (the “IPR Law 2022”), which replaces the 1st Amendment of the 2005 IP Law in 2009 and the 2nd Amendment in 2019. The IP Law 2022 will take effect from 1 January 2023, save for the regulation on sound marks and the regulation on protection of experimental data for agrochemical products that will be effective from 14 January 2022 and from 14 January 2024 respectively. The IP Law 2022 has revised quite a lot of regulations related to objects of intellectual property rights in Vietnam, which especially with respect to trademarks.
